Man Wrongfully Accused of Taking an Upskirt Photo → Investigator Falsifies Statements: “Hobbies Include Watching Adult Videos”

A Tokyo man was accused for attempting to take upskirt photos with his phone, arrested by police, and was taken to court for violating the Tokyo Nuisance Prevention Ordinance. However he was found not guilty during appeals, and requested compensation for damages on 12/17. It became clear that “during interrogation, the investigator falsified statements in the work papers,” and the city was ordered to pay 1,100,000 yen ($10,530).

According to the judgement, in June 2008, the man was viewing an image on his cellphone while ascending an escalator. A woman suspected that he was taking an upskirt photo, so she promptly found an officer and he was escorted to the police station. The investigator falsified his statements, fabricating descriptions such as “his hobbies is to watch upskirt videos” and “he saw a woman and his carnal desires took control.” The judge noted that “the investigation work papers are a very crucial piece of evidence, and this created an unfair disadvantage to the man.”

In September 2008 the man was indicted for the crime, and was ordered by the court to pay a 300,000 yen ($2,871) penalty, but the Tokyo High Court found him to be not guilty on January 2010.
